Terms & Conditions

These Terms & Conditions govern all projects and services provided by Sunset Studio LLC ("Sunset Studio," "we," "us") to our clients ("you"). By engaging our services, you agree to these terms.

Project Agreement

All projects begin with a written scope of work, proposal, or project agreement that outlines the deliverables, timeline, and total cost. Work does not begin until both parties have agreed to the scope in writing and the deposit has been received.

Payment

A non-refundable deposit of 50% of the total project fee is required before work begins. The remaining 50% is due upon project completion, prior to the transfer of final files, code, or site credentials.

Payments are accepted via invoice. All fees are in US dollars.

Cancellation

If you choose to cancel a project after work has begun, the deposit is non-refundable. If work completed at the time of cancellation exceeds the value of the deposit, we reserve the right to invoice for the difference based on time and work documented to that point.

Late Payment

Invoices are due upon receipt unless otherwise stated in the project agreement. If an invoice remains unpaid after 14 days, we reserve the right to pause all active work on your project until the outstanding balance is settled. Project timelines will extend accordingly, at no fault of Sunset Studio.

Revisions

Each project includes two rounds of revisions as outlined in the project scope. Revisions beyond this are billed at our standard hourly rate, which will be communicated before additional work begins.

Client Responsibilities

You agree to provide all necessary content, materials, feedback, and approvals in a timely manner. Delays caused by late content or approvals may affect the project timeline and are not the responsibility of Sunset Studio.

Intellectual Property

Upon receipt of final payment, you receive full ownership of the final deliverables — including design files, code, and any other assets created specifically for your project. Ownership does not transfer until the final invoice is paid in full.

We retain ownership of any preliminary concepts, drafts, or work not included in the final deliverables.

Portfolio Rights: We reserve the right to display completed work in our portfolio, on our website, and in promotional materials. If your project is confidential, please notify us in writing before the project begins and we will honor that request.

Confidentiality

We treat all client information as confidential. We do not share your business details, project specifics, or any proprietary information with third parties.

Warranties

We take pride in our work and will deliver it to the best of our professional ability. However, we make no guarantee of specific business outcomes — including search engine rankings, traffic, or revenue — as these depend on many factors outside our control.

Limitation of Liability

Sunset Studio's liability for any claim arising from our services is limited to the total fees paid by you for the project in question. We are not liable for any indirect, incidental, or consequential damages.

Governing Law

These Terms & Conditions are governed by the laws of the State of Hawaii, regardless of where you are located. Any disputes will be resolved through binding arbitration in Honolulu, Hawaii.

Changes to These Terms

We may update these terms from time to time. The version in effect at the time your project agreement is signed governs that engagement.
